The United States Constitution

Article II, Section 1 of the U.S. Constitution imposes only three eligibility requirements on persons serving as president, based on the officeholder's age, time of residency in the U.S., and citizenship status:

"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States."

A Proclamation

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Whereas Clauses

WHEREAS Edward Joseph Snowden, a former contractor for the National Security Agency, stands charged by the United States with violations of the Espionage Act (18 U.S.C. Section 793(d)), theft of government property (18 U.S.C. Section 641), and other related statutes, all arising from his unauthorized disclosure of classified information concerning domestic and foreign surveillance programs operated by the United States Government; and

WHEREAS the revelations brought to public light by Edward J. Snowden prompted a global examination of state surveillance practices, informed a significant public debate, and led directly to legislative and judicial reforms that strengthened the privacy protections of the American people; and

WHEREAS the President of the United States possesses the plenary power to grant reprieves and pardons for offenses against the United States, as set forth in Article II, Section 2, Clause 1 of the Constitution, and possesses the authority to exercise that power for the public welfare when justice and the national interest so require;

NOW, pursuant to the pardon power vested in the President by Article II, Section 2, Clause 1 of the Constitution, and by the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Grant of Pardon

Grant of Pardon. Edward Joseph Snowden is hereby granted a full, free, and absolute pardon for any and all offenses against the United States that he has committed or may have committed, or been charged with, arising out of or in connection with the unauthorized possession, retention, disclosure, or publication of classified information concerning intelligence activities, surveillance programs, or related matters, up to and including the date of this proclamation.

Directives to the Attorney General

Directives to the Attorney General. The Attorney General is directed to take all necessary steps to dismiss any pending charges against Edward Joseph Snowden with prejudice, to terminate any ongoing extradition or rendition proceedings, and to ensure that all legal disabilities flowing from the aforementioned charges are removed. The official records of the Department of Justice and all agencies of the executive branch shall reflect that Edward Joseph Snowden stands fully and unconditionally pardoned for said offenses.

Effective Date and Archival Filing

This grant of presidential clemency is effective immediately upon my signature, and this proclamation shall be entered upon the permanent archives of the United States.

Witness Clause

IN WITNESS WHEREOF, I have hereunto set my hand this 20th day of January, in the year of our Lord two thousand and twenty-nine, and of the Independence of the United States of America the two hundred and fifty-third.
