Executive Order on Establishing the National Disaster Resilience Fund and Safeguarding Relief Operations for the American People
By the authority vested in me as President of the United States by the Constitution and the laws of the United States of America, it is hereby ordered:
Section 1: Purpose
The Federal Emergency Management Agency (FEMA) plays a crucial role in responding to natural disasters and ensuring the safety of the American people. However, in recent years, FEMA's funding has been insufficient to cover the increasing costs of disaster relief and recovery, leaving the agency in deficit. To better protect American lives and property, this executive order will resolve FEMA's deficit, provide for unlimited funding during natural disasters, and ensure that relief funds are used transparently and ethically.
Section 2: Establishment of the National Disaster Resilience Fund
(a) A new National Disaster Resilience Fund (NDRF) shall be established under the U.S. Department of the Treasury. The NDRF will provide FEMA with immediate and unrestricted access to funds necessary for responding to natural disasters, without any cap, ensuring that all necessary resources are available for the protection of life and property.
(b) The NDRF will be subject to 100% transparency and open public observation. All disbursements, allocations, and expenditures will be published in real-time through a publicly accessible online portal, ensuring that every dollar spent is accounted for and can be reviewed by the public.
Section 3: Federal Contractor Regulations During Natural Disasters
(a) To prevent profiteering during times of crisis, all federal contractors engaged in disaster relief services will be prohibited from engaging in price gouging. The Office of Federal Procurement Policy (OFPP) will issue strict guidelines to cap contractor profits at a reasonable margin, ensuring that these events are treated as public service efforts, not as profit-driven ventures.
(b) The Department of Justice will work in conjunction with the OFPP and the Federal Trade Commission (FTC) to rigorously enforce price gouging laws, ensuring contractors who violate these terms face penalties, including fines and suspension from federal contracting.
(c) In the event of a disaster, contracts will prioritize local businesses to support economic recovery in affected areas.
Section 4: Public Oversight and Transparency
(a) The establishment of a Public Disaster Oversight Committee will ensure independent supervision of FEMA’s financial activities. This committee, made up of civic leaders, non-governmental organizations, and experts in disaster management, will publish quarterly reports to ensure ongoing accountability of FEMA’s disaster funding and operations.
(b) FEMA will also develop a transparent online audit system that provides the public with up-to-date information on all expenditures, contracts, and funds used for disaster relief efforts.
Section 5: Financial Integrity and Prevention of Misuse
(a) FEMA will coordinate with the Office of the Inspector General (OIG) to ensure that all funds disbursed from the NDRF are subject to regular and independent audits, protecting taxpayer money and preventing any misuse or fraud.
(b) Special focus will be placed on preventing fraudulent claims or misuse of relief funds, with additional personnel and technological resources devoted to swiftly identifying and penalizing offenders.
Section 6: Implementation
(a) Within 60 days of this Executive Order, FEMA, in consultation with the Department of Treasury, OFPP, and the Department of Justice, shall publish detailed regulations to implement the provisions of this order.
(b) The Government Accountability Office (GAO) will submit a report to Congress within 180 days detailing the effects of these regulations, FEMA’s deficit reduction, and overall disaster response improvements.
Section 7: General Provisions
(a) Nothing in this order shall be construed to impair or otherwise affect the authority granted by law to an executive department, agency, or the head thereof, or the functions of the Director of the Office of Management and Budget.
(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This order is not intended to create, and does not create, any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
Section 8: Effective Date
This Executive Order shall take effect immediately.
